Evictions in the state of Maryland were put on hold effective March 16, 2020 due to COVID19. On May 25th the state of Maryland issued a statement announcing the eviction ban for non payment of rent and tenant holdovers will be lifted on July 25, 2020. July 25, 2020 is also the same day the Federal Ban on Evictions on properties with Federally subsidized loans will expire. This means that 30 day notices to vacate can also be given to tenants who have had leases expire or are on month to month leases.
A couple of important notes: 1. There is a new additional form that needs to be filed in the state of MD with every eviction. This form ensures that the property is in compliance with the last remaining provision of the CARES act ensuring the property is not federally subsidized and receiving mortgage forbearance.
2. To file an eviction on a tenant the owner must cancel any forbearance agreement with the bank. You cannot evict a tenant while your mortgage payments are being delayed under the CARES Act.
3. The best practice to deal with delinquencies due to COVID19 is to communicate with your tenants and to create a payment plan to avoid eviction. The majority of our tenants have been receiving government benefits and/or will be going back to work shortly. In some circumstances with have negotiated longer lease terms with back pay being added to future payments to get caught up.
